Introduction

Genuiti Software, Inc. (“Genuiti”, “we”, or “us”), doing business as TrueRev, respects your privacy, and this Privacy Policy is designed to help you understand how we collect, use, and disclose your personal information. Genuiti owns and operates a website located at www.truerev.com and other locations on the Internet (the “Site”) and a hosted service which collectively provide tools that enable you to accept, elect, track, transact, and perform certain other administrative functions related to your organizations order to cash process (the Site together with any other products and services offered by Genuiti, are collectively referred to as the “Service”). By using the Service, you accept and consent to the practices described in this Privacy Policy. The Information We Collect

We collect a variety of information from you and other sources when you use the Service, including technical information as well as information that can be used to identify you individually, sometimes referred to as “personal information.”

To use the Service, you will be required to create an account with us. You may sign up for an account for the Service on our Site, located at https://www.truerev.com, or if your employer (“Employer”) has partnered with Genuiti, you may also receive an email from us inviting you to create an account to use the Service. During the registration process, you will be required to create a user ID and password in order to establish an account for the Service. We may ask you for certain personal information during the account set-up process, or your Employer may provide us with certain personal information about you that you have already provided to them, including but not limited to your name, email address and employment-related information such as your employer name, and occupation.

When you use the Service, we may automatically collect a variety of information about your use of the Service in log files, such as your IP address, device ID, operating system, and browser type, as well as information regarding transactions you may engage in using the Service. This information is gathered for all users. We may also use “cookies,” or small pieces of information that are stored by your browser on your computer's hard drive so that the Service may access that information on return visits. We generally do not store or retrieve any personally identifiable information in cookies. If you have set your browser to reject cookies, you may not be able to take full advantage of all the features of the Service.

We may also collect personal information from you if you contact us for any reason through email, phone, mail, or other similar means, or through any interactions you may have with Partners, users, or other parties.

Use of Information Obtained by Genuiti

Genuiti uses personal information you provide or that we collect for the following general purposes:

  1. to contact you, to facilitate your access to information regarding the Service, and to comply with laws and regulations regarding use of the Service, such as to address intellectual property infringement and rights of privacy,
  2. to respond to your inquiries, for administrative purposes, for other customer service purposes, and as otherwise necessary to provide, operate, maintain, and enhance, the Service;
  3. to send you certain communications relating to the Service and your account with us, including but not limited to notifications, service announcements, and administrative messages without offering you the opportunity to opt-out of receiving them;
  4. to understand and analyze the usage trends and preferences of users of the Service, and the effectiveness of our marketing and communication efforts, so that we can continually improve our offerings.

Genuiti uses automatically collected technical information, “cookies” information, and any other information we collect from you during registration or at other times to personalize the Service for you (such as remembering your information so that you will not have to re-enter it during your visit or the next time you use the Service), monitor and analyze the effectiveness of the Service, monitor aggregate usage metrics such as total number of users, and improve the functionality and appearance of the Service.

Third Party Advertising

Advertisements that may appear on Genuiti are sometimes delivered (or “served”) directly to users by third party advertisers. They automatically receive your IP address or device ID when this happens. Third party advertisers may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize their advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. Third party advertisers have no access to your contact information.

Genuiti does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in. However, please note that if an advertiser asks Genuiti to show an advertisement to a certain audience or audience segment and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they were trying to reach.

You should consult the respective privacy policies of these third-party ad servers or ad networks. Genuiti's Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or websites.

Changing or Removing Information

Genuiti may offer a limited ability to correct and modify your account information by logging onto your account from a computer. Information will be updated in our databases, but may not immediately be reflected in your account for a period of time. We will generally try to email you with a confirmation of any changes that you have made to your account information within the next business day, but that process may take longer depending upon network status or if we need to verify the changes that you have made. Individuals who wish to deactivate their Genuiti account may do so by emailing us at legal@truerev.com We may preserve your account information required to do so by law or in a good faith belief that such preservation is reasonably necessary to (a) comply with legal process; (b) enforce this Privacy Policy or other policies; (c) respond to you if you contact us for any reason; (d) protect the rights, property, or personal safety of Genuiti, its users, and the public; and (e) take other actions as permitted by law.

Genuiti reserves the right, for security purposes, to limit changes and modifications to your account and require that any changes to your personal information be made through your Employer. This is generally done upon the request of your Employer, and may be performed to prevent fraud and limit the possibility of unauthorized changes to your account.

Security

Genuiti takes certain precautions to protect our users' information and to limit the risk that it will be accessed without authorization, including use of certain industry standard technologies and practices. We cannot, however, ensure or warrant the security of any information you transmit to Genuiti, and you do so at your own risk. If Genuiti learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Modifications to this Policy

Genuiti may from time to time revise this Privacy Policy. If we do, we will post those changes on the Service and indicate the new effective date so that you are always aware of what information we collect and how we use it. For changes to this Policy that may be materially less restrictive on our right to use or disclose your personal information, we will attempt to notify you by electronically or by mail, phone, or other similar means before implementing the change. Without your consent, we will only use and disclose your information in a manner consistent with the version of the Privacy Policy that was in effect at the time we collected that information. We encourage you to periodically review this Policy to stay informed about how we are protecting the information we collect from you.

International customers

The Service is hosted in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States which does not have the same data protection laws as your jurisdiction, and by providing your personal data you consent to:

  1. the use of your personal data for the purposes identified above in accordance with this Privacy Policy; and
  2. the transfer of your personal data to the United States as indicated above.

In the event of merger or sale

In the event that all or a portion of Genuiti or its assets are acquired by or merged with a third party entity, Genuiti reserves the right, in any of these circumstances, to transfer or assign the information that we have collected from users in connection with such merger, acquisition, sale, or other change of control.
